This privacy policy discloses the privacy practices for Zach Herbert LLC (”We”, “Us”, “Our”). This privacy policy applies solely to information collected by this web site, ZachHerbert.com. It will notify you of the following:
- What personally identifiable information is collected from you through the web site, how it is used and with whom it may be shared.
- What choices are available to you regarding the use of your data.
- The security procedures in place to protect the misuse of your information.
We are the sole owners of the information collected on this site. We only have access to/collect personally identifiable data that you voluntarily give us via registration, email or other direct contact from you. We will not sell or rent this information to anyone.
CONTACT FORMS
Should you choose to contact us using the our Contact Us page or One-on-One Coaching Request, your name and email address will be stored within this website’s database. This information will not be visible on the website, and does not automatically add your email address to our email list. (If you want to receive email updates, you have to sign up for those manually.) Your name and email will only be used to reply to your inquiry and will not be shared with any third party data processors. Your information will remain within our database unless you request that we remove it by Contacting Us.
That might sound like an infinite loop… Contacting us to request that a previous contact us be deleted… But we’ve planned ahead for such occasions. The request for deletion will ALSO be deleted, like one of those awesome self-destructing spy messages!
GET EMAIL UPDATES
If you choose to receive email updates, the email address that you submit to us will be forwarded to Aweber, a THIRD PARTY DATA PROCESSOR, who provides us with email services. Email addresses submitted in this way are not stored in our website’s database.
Your email address will remain within Aweber’s database for as long as we continue to use Aweber’s services, or until you specifically request removal from the list. You can do this by unsubscribing using the unsubscribe links contained in any email newsletters that we send you or by Contacting Us. When requesting removal, please contact us using the email account that is subscribed to the mailing list.
While your email address remains within the Aweber database, you will receive periodic (usually weekly) email updates containing information on new articles and episodes, news and promotions.
REGISTRATION
This website includes an optional registration form. During registration a user is required to give certain information, such as name and email address. This information is used to create your member profile and also adds your email address to our MEMBER EMAIL list (see below). The information you submit is stored in our website’s database. (We can see your name and email in the database, but the password you choose is encrypted. We can’t see that.) This information is used to allow you to log in to your account and to see members only sections of the site.
You may unsubscribe from the member email list at any time by using the “unsubscribe” links at the bottom of any email newsletter that we send you. Unsubscribing from the mailing list does not delete your member profile, and it does not delete your information from this website’s database. (That information still needs to be there for you to log in, even if you don’t want to receive emails.) If you ever want to delete your membership and all associated personal data, please Contact Us.
Registering for a paid membership tier will also request payment information. (See ORDERS below.) This credit card information is not stored in this website’s database.
Please note, there are no refunds for paid memberships. And if you request that your profile and information be deleted, you will no longer have access to those areas of the site.
MEMBER EMAILS
Registering on this site also adds your email to our member email list on Aweber. These emails are used to deliver the Crash Course, and to send occasional updates, news and promotions. There’s no set schedule for these, and we don’t usually send normal content updates (for new episodes and articles) to this list. That way you can get important news and updates, but not necessarily weekly content updates. If you want more frequent updates, you should sign up for these separately using the GET EMAIL UPDATES feature.
ORDERS
We request information from you on our order form. To buy from us, you must provide contact information (like name and email address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you. Credit card payments are processed using Stripe, a THIRD PARTY DATA PROCESSOR (see below). Your credit card information is not stored in our website’s database.
BLOG COMMENTS
Should you choose to add a comment to any posts that we have published on this site, the name and email address (and optional website address) you enter with your comment will be saved to this website’s database, along with your computer’s IP address and the time and date that you submitted the comment. This information is only used to identify you as a contributor to the comment section of the respective blog post and is not passed on to any of the third party data processors detailed below. It also does not automatically add your email to our mailing list. If you want to receive EMAIL UPDATES, you must subscribe to those manually. (If you select the checkbox to “Notify me of follow-up comments by email” then you will receive emails letting you know that someone else has commented. But this won’t add you to the Aweber email list either.)
Only your name will be shown on the public-facing website, although if the supplied email address is linked to a Gravatar account, your Gravatar photo will also be displayed. If you include the optional website address, that will be visible as a link on your name in the comment section. We may also use excerpts of your comment as a TESTIMONIAL on our site. Testimonials will only display your first name as an attribution. No other personal data is included. (See below.)
Your comment and it’s associated personal data will remain on this site until we see fit to either 1.) remove the comment or 2.) remove the blog post. Should you wish to have the comment and it’s associated personal data deleted, please Contact Us and let us know.
NOTE: You should avoid entering personally identifiable information to the actual comment field of any blog post comments that you submit on this website.
TESTIMONIALS
We post customer testimonials on our website, along with the first name of the commenter. If you wish to request that your name be removed from a testimonial, please Contact Us.
SOCIAL MEDIA FEATURES
Our website includes social media features, such as the Facebook “Like” button. These features may collect your IP address and the page you are visiting on our website. It may also set a cookie to enable the features to function properly. Social media features are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing it.
SITE VISITATION TRACKING
Like most websites, this site uses Google Analytics (GA) to track user interaction. We use this data to determine the number of people using our site, to better understand how they find and use our web pages and to see their journey through the site. Although GA records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us. GA also records your computer’s IP address which could be used to personally identify you but Google does not grant us access to this. GA makes use of cookies, details of which can be found on Google’s developer guides.
FACEBOOK TRACKING
Like most websites that have a profile on Facebook, this site uses the Facebook Pixel to track user interaction. We use this data to better understand our users and how they use our site. We also use this information to target ads and sponsored posts on Facebook. For example, if a user frequently visits our site, we may include them in a sponsored post when we release new content so that they don’t miss it. (Facebook only shows our content to less than 10% of the users who like our page!) Another example: if a user has already visited an article, we use this information to EXCLUDE them from a sponsored post so we don’t show them an ad for a page they’ve already seen! Although Facebook records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us.
COOKIES
We use “cookies” on this site. Cookies are small pieces of text sent to your web browser by our website. A cookie file is stored in your web browser and allows us, our partners, affiliates, and other service providers to recognize you and make your next visit easier and our service more useful to you. For example, we use cookies for authentication when you log into the members only areas of the site.
Usage of a cookie is in no way linked to any personally identifiable information on our site. You can control the use of cookies at the individual browser level. If you reject cookies, you may still use our website, but your ability to use some features or areas of our website will be limited. (This is just how server/browser interaction works.) If you’d like to delete cookies or instruct your web browser to delete or refuse cookies, please visit the help pages of your web browser.
SHARING
We use THIRD PARTY DATA PROCESSORS to facilitate our business (see below). Including, but not limited to, sending email, scheduling webinars and processing payments. In connection with these offerings and business operations, these third parties may have access to your personal information for use in connection with those business activities. We may also synchronize your data between third party processors. For example, if you register for the site and sign up for a webinar on Webinar Jam, and choose to receive a reminder via Facebook Messenger.
DISCLOSURES
We may disclose your personal information if required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law or comply with legal process served on us or affiliated parties; (b) protect and defend our rights and property, our site, the users of our site, and/or our affiliated parties; (c) act under circumstances to protect the safety of users of our site, us, or third parties.
ACCESS TO PERSONAL INFORMATION
Upon request we will provide you with information about whether we hold any of your personal information. If your personal information changes, or if you no longer desire our service, you may correct, update or delete it by making the changes on your profile page or by Contacting Us. We will respond to your request within 30 days.
We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
SECURITY
The security of your personal information is important to us. When you enter sensitive information, such as login credentials and credit card information, we encrypt the transmission of that information using secure socket layer technology (SSL).
We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

This web site contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. If you submit personal information to any of those websites, your information is governed by their privacy policies. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information. This privacy policy applies only to information collected by our website.

We will report any unlawful data breach of this website’s database to our users within 72 hours of the breach if it is apparent that personal data stored in an identifiable manner has been stolen.
ZOMBIE APOCALYPSE
In the event of a full-scale zombie apocalypse, we may be unable to comply with electronic requests for personal data and deletions. However, we will print out a hard copy of all of our users’ names and identifiable information and keep it with us as we roam the countryside and battle the undead. This list will be used to provide us with warm happy feelings of the lives we used to live, and to help build a new post-civilization community of like-minded survivors. Data requests may still be made in person. And if you would like your information deleted, we will redact it from the list using the juices of dark colored berries, or other available non-creepy fluids.
